Summary
A work experience trainee sustained head injuries after falling from an ATV. He was not wearing any head protection, nor had any been provided. Training had been given by an employee of the farm who himself had not been trained.
Action
The farming Co was prosecuted under Section 3(1) of the Health & Safety at Work etc. Act 1974 for failing to provide adequate training and failing to provide suitable head protection. The company was fined £1,000 plus prosecution costs of £850.63.
Advice
A formal training course should always be provided for operators new to the use of ATV's Safety helmets should be worn by all operators. These should be to BSEN 1384 (ATV helmet) or BS 6658 (motor cycle helmet).
