Freedom of Information
HSE makes a great deal of information available on its website, particularly via published information or HSE Books, although in the latter case some payment may be required. Before making an FOI request, please check these sources to see if the information required is already available.
The Freedom of Information Act makes it clear under section 21, that a public authority does not need to provide information if it is already reasonably accessible, before making a request under FOI applicants should check these sources.
However, more generally, as the FOI Act imposes a duty on public authorities to provide advice and assistance, an applicant who has had his request for information refused for this reason can be directed to the relevant source.
The Freedom of Information Act 2000 and the Environmental Information Regulations 2004 provide information access rights to members of the public and organisations. Although most requestors exercise their rights sensibly and responsibly, some individuals and organisations may abuse them, whether intentionally or not. The Information Commissioner’s Office (ICO) has produced a charter which sets out how the rights can be used responsibly and which will help users to make legitimate FOI requests.
